Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions and our Privacy Policy. These Terms and Conditions apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Service.

3. Personal Information & Account Security

When creating an account with us, You must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account.

• You are responsible for safeguarding the password that You use to access the Service.
• You agree not to disclose Your password to any third party.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

The Service is protected by copyright, trademark, and other laws of Australia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Wish & Gifts.

Our Service may contain links to third-party websites or services that are not owned or controlled by Wish & Gifts. Wish & Gifts has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Wish & Gifts shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

6. Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service or contact us to request account deletion.

7. Refunds of Transactions

Once funds have been transferred to a host's account, refunds cannot be processed by Wish & Gifts. Users must verify all transaction details for accuracy before processing. For disputes regarding transactions, please contact us within 7 days of the transaction. We encourage both hosts and guests to communicate directly regarding any refund requests prior to contacting our support team.

8. Transaction Fees

Wish & Gifts applies transaction fees for processing gifts. The fee structure is as follows:

• Basic Plan: 5% transaction fee on gifts received
• Monthly Subscription: 3% transaction fee on gifts received
• Payment processing fees may apply depending on payment method

9. Accounts & Account Cancellation

Wish & Gifts reserves the right to cancel any account at its discretion if the account is deemed not in the best interest of the company or if the service is being misused. Users will be notified of account cancellation and any pending withdrawals will be processed according to our standard procedures.

10. SMS/Text Messaging Consent

By providing your phone number and opting into our text messaging program, you consent to receive a one-time transactional security code on your mobile device. Standard message and data rates may apply. For assistance, reply HELP to the number from which you received the message, or contact us at admin@wishandgifts.com. To stop receiving messages, reply STOP at any time. Carriers are not liable for delayed or undelivered messages.

11. Changes to Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
